OFF GRID KIWI TERMS OF SERVICE

These Terms of Service explain the conditions that apply when you visit, use or purchase from the Off Grid Kiwi website.

In these terms, “Off Grid Kiwi”, “we”, “us” and “our” refer to Off Grid Kiwi, a New Zealand-based sole-trader business. “You” and “your” refer to the customer or website user.

By using our website or placing an order, you agree to these terms and our Privacy Policy, Return and Refund Policy and Shipping Policy. These policies are available through the footer of our website.

  1. ABOUT OUR STORE

Off Grid Kiwi sells printed-to-order clothing, outdoor-inspired merchandise and related products.

Our store is powered by Shopify. Shopify provides the ecommerce platform that enables us to sell our products, but purchases made through this store are made directly between you and Off Grid Kiwi.

We are operating in trade for the purposes of the New Zealand Fair Trading Act 1986 and Consumer Guarantees Act 1993.

  1. ELIGIBILITY AND ACCOUNTS

You must be legally capable of entering into a purchase agreement or have the permission and supervision of a parent or legal guardian.

You are responsible for ensuring that all information supplied during checkout is complete and accurate. If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account.

  1. PRODUCTS AND MADE-TO-ORDER PRODUCTION

Most Off Grid Kiwi products are created especially for you after your order is placed. Production generally begins after the order has been approved for fulfilment.

We make reasonable efforts to display product colours, artwork, dimensions and other details accurately. Colours may appear differently depending on your device or screen settings. Minor variations in print placement, colour and finish can also occur during production and do not necessarily constitute a defect.

Product availability, designs, colours and sizes may change or be discontinued without notice.

  1. ORDERS

Submitting an order is an offer to purchase. An order is accepted once payment has been successfully processed and we confirm the order.

We may decline or cancel an order where:

• Payment cannot be processed
• A product or variant is unavailable
• Pricing or product information contains a material error
• We reasonably suspect fraud, misuse or unlawful activity
• We cannot fulfil the order on the terms advertised

If we cancel an order after payment has been taken, we will provide an appropriate refund.

Please check your product, size, colour, quantity and delivery information carefully before completing checkout.

  1. CANCELLATIONS AND CHANGES

Contact us immediately at hello@offgridkiwi.co.nz if you need to change or cancel an order.

Because products are made to order, we cannot guarantee that an order can be changed or cancelled after it has entered production. If production has not started, we will make reasonable efforts to assist.

  1. PRICES AND PAYMENT

Unless stated otherwise, prices displayed on the Off Grid Kiwi store are in New Zealand dollars.

Shipping charges and any applicable taxes are displayed during checkout before you complete your purchase.

Prices, promotions and discounts may change without notice. The price that applies to your order is the price shown when the order is submitted, except where there is an obvious pricing or technical error.

Payments are processed securely through Shopify and its approved payment providers. Off Grid Kiwi does not directly store your complete payment-card details.

  1. SHIPPING AND DELIVERY

Products may be produced and shipped by third-party print and fulfilment providers. An order containing multiple products may arrive in separate packages.

Delivery timeframes are estimates and include both production and shipping. Delays may occur because of carrier disruption, customs processing, severe weather, peak periods or other events outside our reasonable control.

We will provide tracking information when it becomes available. You are responsible for supplying a complete and accurate delivery address.

If an order is delayed, lost, damaged or not delivered, contact hello@offgridkiwi.co.nz so we can investigate and provide any remedy required under applicable law.

Nothing in these terms removes any responsibility Off Grid Kiwi has for delivery under the New Zealand Consumer Guarantees Act or other applicable law.

  1. RETURNS, REFUNDS AND FAULTY PRODUCTS

Because our products are printed to order, we do not accept returns or exchanges for change of mind, incorrect size or colour selection, or other customer ordering errors.

If a product arrives damaged, defective, misprinted, incorrect or otherwise fails to meet a legal consumer guarantee, contact us within 30 days of delivery where reasonably possible. Include your order number, a description of the problem and clear photographs.

Depending on the circumstances and your legal rights, the remedy may include a replacement, refund or another appropriate solution.

Nothing in these terms limits any rights or remedies available under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable consumer law.

  1. PRODUCT CARE AND SIZING

Customers are responsible for reviewing the size guide and product information before ordering.

Follow the care instructions supplied with the product. Damage caused by misuse, incorrect washing, ordinary wear and tear or failure to follow reasonable care instructions may not qualify as a product defect.

  1. INTELLECTUAL PROPERTY

Unless otherwise stated, the Off Grid Kiwi name, logos, artwork, product designs, photographs, written content and other original materials on this website are owned by or licensed to Off Grid Kiwi.

These materials are protected by applicable New Zealand and international intellectual-property laws.

You may view and use the website for personal, non-commercial purposes. You must not copy, reproduce, distribute, modify, sell or commercially exploit our branding, artwork or website content without written permission.

Third-party names, trademarks and content remain the property of their respective owners.

  1. ACCEPTABLE WEBSITE USE

You must not use our website:

• For unlawful, fraudulent or malicious purposes
• To infringe another person’s rights
• To upload or transmit harmful code
• To interfere with the website’s operation or security
• To collect information about other users without permission
• To impersonate another person or provide deliberately false information
• To scrape, copy or commercially exploit website content without permission

We may restrict or suspend access where reasonably necessary to protect the store, our customers or other parties.

Personal information may be processed by Shopify, payment providers, fulfilment partners and delivery providers where necessary to operate the store, process payments, produce products and deliver orders.

  1. REVIEWS, FEEDBACK AND CUSTOMER CONTENT

If you submit a review, photograph, comment or other content, you confirm that:

• You have the right to submit it
• It is accurate and not misleading
• It does not infringe another person’s rights
• It is not unlawful, abusive or harmful

You give Off Grid Kiwi a non-exclusive, worldwide and royalty-free permission to use and display that content for operating and promoting the business. We may remove content that breaches these terms or applicable law.

  1. ERRORS AND WEBSITE AVAILABILITY

We may correct errors or update product descriptions, prices, availability and other website information.

We do not guarantee that the website will always be available or free from interruption. Planned maintenance, technical problems or events outside our control may temporarily affect access.

If an error materially affects an order, we will contact you and provide an appropriate solution.

  1. WARRANTIES AND LIABILITY

Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the New Zealand Consumer Guarantees Act.

To the fullest extent permitted by law, Off Grid Kiwi is not responsible for indirect or consequential loss that was not reasonably foreseeable when the order was placed.

You are responsible for ensuring that products are suitable for any special purpose that you have not clearly communicated to and had confirmed by us before purchase.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, carrier disruption, industrial action, border restrictions, supply interruption, civil emergency or major technical failure.

We will take reasonable steps to minimise the effects of these events and communicate material delays where practicable. This section does not limit rights that cannot lawfully be excluded.

  1. CHANGES TO THESE TERMS

We may update these terms to reflect changes to our products, services, suppliers, website or legal obligations.

The current version will be published on this website with an updated date. Changes will not retrospectively reduce rights relating to an order already accepted.

  1. SEVERABILITY

If any part of these terms is found to be unlawful or unenforceable, that part will be limited or removed only to the extent necessary. The remaining terms will continue to apply.

  1. GOVERNING LAW

These terms and purchases made through the Off Grid Kiwi store are governed by the laws of New Zealand.

Nothing in this section prevents a consumer from relying on any mandatory rights that apply in the country or region where they live.
